Please read these terms and conditions carefully before using our services. By engaging Cedar Grove Concrete for any project, you agree to be bound by these terms.
Acceptance of Terms
By accessing our website, requesting an estimate, or engaging Cedar Grove Concrete for any services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
These terms constitute a legally binding agreement between you ("Client", "Customer", or "you") and Cedar Grove Concrete ("Company", "we", "us", or "our"). We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting on our website.
Your continued use of our services following any modifications indicates your acceptance of the updated terms. We encourage you to review these terms periodically to stay informed of any changes.
Services Description
Cedar Grove Concrete provides professional concrete construction and finishing services including, but not limited to:
- Residential and commercial foundation work
- Driveways, patios, walkways, and other flatwork
- Decorative concrete including stamped, stained, and exposed aggregate finishes
- Retaining walls and structural concrete elements
- Concrete repair, restoration, and replacement services
The specific scope of work for each project will be detailed in a written estimate or contract provided to the client prior to commencement of work.
Estimates & Pricing
All estimates provided by Cedar Grove Concrete are valid for 30 days from the date of issue unless otherwise specified in writing. Estimates are based on conditions observed during our site assessment and information provided by the client.
Price Adjustments: We reserve the right to adjust pricing if unforeseen conditions are discovered during the project, including but not limited to: unsuitable soil conditions, hidden utilities, undisclosed structures, or changes in material costs exceeding 10% from the estimate date.
Change Orders: Any changes to the original scope of work requested by the client will require a written change order with associated cost adjustments. Work on change orders will not commence until the client approves the additional costs in writing.
Site Access: Estimates assume reasonable access to the work area. Additional charges may apply for restricted access, long-distance material transport, or special equipment requirements not apparent during initial assessment.
Payment Terms
Payment terms are as follows unless otherwise agreed upon in writing:
- Deposit: A deposit of 25-50% (depending on project size) is required to schedule work and secure materials
- Progress Payments: For larger projects, progress payments may be required at specified milestones
- Final Payment: Balance is due upon completion of work, prior to final walkthrough approval
Late Payments: Accounts not paid within 30 days of the invoice date may be subject to a 1.5% monthly interest charge. We reserve the right to suspend work on any project with outstanding balances and to place a mechanic's lien on the property for unpaid amounts.
Accepted Payment Methods: We accept cash, check, credit cards (processing fees may apply), and bank transfers.
Warranty & Guarantees
Cedar Grove Concrete stands behind our workmanship with the following warranty coverage:
Structural Work: 10-year warranty against structural defects in foundations and load-bearing concrete elements, covering cracks wider than 1/4 inch or settlement exceeding normal tolerances.
Flatwork: 5-year warranty against structural failure, excessive cracking (beyond normal shrinkage cracks), or surface delamination under normal use conditions.
Decorative Finishes: 2-year warranty on stamped, stained, and specialty finishes against peeling, flaking, or color failure when properly maintained according to our care guidelines.
Exclusions: Warranties do not cover damage resulting from: improper use or overloading, chemical exposure, vehicle damage, failure to follow maintenance recommendations, acts of nature, soil movement, or modifications made by others.
Limitation of Liability
To the maximum extent permitted by law, Cedar Grove Concrete's liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from our services.
Force Majeure: We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: adverse weather conditions, natural disasters, labor disputes, material shortages, or government actions.
Client Responsibilities: The client is responsible for ensuring proper maintenance of completed work, providing accurate information about site conditions, and obtaining any necessary permits or approvals not explicitly included in our scope of work.
Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Cedar Grove Concrete and is protected by copyright and other intellectual property laws.
Project Photography: By engaging our services, you grant Cedar Grove Concrete the right to photograph completed projects for use in our portfolio, marketing materials, website, and social media. If you prefer your project not be photographed or shared, please notify us in writing prior to project commencement.
Design Rights: Custom designs, patterns, or specifications created by Cedar Grove Concrete for your project remain our intellectual property and may not be reproduced or shared with other contractors without our written consent.
Termination
Client Termination: You may terminate a project at any time by providing written notice. Upon termination, you will be responsible for payment of all work completed to date, materials ordered or delivered, and a reasonable cancellation fee to cover scheduling and administrative costs.
Company Termination: We reserve the right to terminate or suspend work if: payment is not received as agreed, the client fails to provide necessary access or approvals, or conditions arise that make the project unsafe or impractical to complete.
Effect of Termination: Upon termination, all outstanding balances become immediately due. Any materials or work completed remain the property of the client only upon full payment.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
Dispute Resolution: Any disputes arising from these terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Chicago, Illinois, in accordance with the rules of the American Arbitration Association.
Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
